Mining engineer in charge

If you have a foreign education or professional qualification and wish to practice your profession in Norway, you generally need approval or authorisation. You will find information about documentation requirements, the application process and regulations here. The competent authority will assess whether you meet the requirements to practice the profession and use the professional title in Norway. If you intend to establish in Norway and work permanently in your chosen profession, the rules below apply to you. However, if you wish to work in Norway for shorter periods of time within your chosen profession, the rules for temporary provision of services apply.

About this form

Applications can only be submitted by the professional/individual. Please submit your application with attachments to the Directorate of Mining.

Establishment:

If you wish to establish yourself or work for an extended period in Norway within your profession, you must apply for recognition from the competent recognition authority before you can practice this profession in Norway.

Temporary provision of services:

You can work temporarily in this profession if you are already legally established in an EEA country or Switzerland and can practice the same profession in that country. To be able to work in this profession temporarily in Norway, you must submit a prior declaration to the competent authority.

Documentation requirements for establishment:

  • Certified copy of evidence of formal qualifications.
  • Proof of the applicant’s nationality.
  • CV.

Documentation requirements for temporary provision of services:

  • Proof of nationality: certified copy of passport or ID-card
  • Certificate confirming that the applicant is legally established in an EEA country as a Mining engineer in charge and that the certificate is valid at the time of the application confirming that the applicant is not subject to any prohibitions to practice the profession.
  • Certified copy of completed education relevant to the practice of the profession and a CV that shows relevant work experience
  • In cases where the profession and education is not regulated in the home country, the applicant must document minimum of one year work experience within the last ten years from an EEA country outside of Norway.

When the mining engineer in charge does not meet the educational requirements that apply to the extraction operation, an application for approval must be submitted to the Directorate of Mining. Approval is only granted for a specific extraction operation, not as a general authorisation to practise a profession as a mining engineer in charge. It is the scope of the extraction and if the extraction is underground or in opencast mining facilities that determines whether approval is required.

The mining engineer in charge is responsible for ensuring that:

  • the deposit is extracted in a sustainable manner
  • operations comply with an up-to-date and approved operating plan at all times
  • operations take place in a technically satisfactory manner such that considerations for employees, nearby buildings and the environment in general are safeguarded

The function of mining engineer in charge is seen in relation to each individual extraction operation, and the qualification requirements that apply to the mining engineer in charge depends on the scope and complexity of the operation. 

  • Mining engineers in charge of subsurface extraction (mines) or opencast mining facilities with a total annual extraction of more than 500,000 m3 of matter shall be educated to at least Master of Technology level, and have completed specialist training in the operation of mineral resources (Section 3.2 of the Regulations).
  • Mining engineers in charge of opencast mining facilities with a total annual extraction of between 15,000 m3 and 500,000 m3 of matter shall have completed a two-year course of training at a vocational college, which shall have included specialisation in rock engineering. Persons who have passed the mine foreman examination administered by the Norwegian national mining college (Statens bergskole) shall be deemed to hold an equivalent qualification (Section 3-3 of the Regulations).

Language requirements:

No, but the competent authority may require proof of sufficient Norwegian language knowledge necessary for practicing the profession.

Criteria/conditions for recognition: 

The statutory qualification requirements related to the practice of the profession are stipulated in the Regulations issued pursuant to the Minerals Act, Section 4.

The statutory requirements for being entitled to recognition of professional qualification from abroad are stipulated in the Act on the Recognition of Professional Qualifications (Professional Qualifications Act) and the Regulation on the Recognition of Professional Qualifications (Professional Qualifications Regulation).

Case processing deadlines:

Establishment:The competent authority must acknowledge receipt of your application within one month of receiving it and inform you of any missing or incomplete documentation.

Following the submission of a complete application, the competent authority should complete processing your application within three months.

Temporary provision of services:

You can practice your profession after you have sent the prior notification with required documents to the competent authority.

Fees:

The Directorate of Mining does not charge a fee for processing applications for recognition.

Right of appeal:

If you are not satisfied with the outcome of the decision, you may appeal in writing, pursuant to Chapter VI of the Public Administration Act. If your application is processed in accordance with the Professional Qualifications Act, the right of appeal also applies if the competent authority has exceeded the case processing deadlines (see Case processing deadlines above).
