Duty to send notification of measures that may cause major pollution problems

If you are planning activities or measures that may cause major pollution problems, you have a duty to notify the Norwegian Environment Agency at an early stage of the planning.

Any person/enterprise planning activities or measures that may cause major pollution problems.

Notification must be sent when planning activities or measures that may cause major pollution problems, including the risk of extensive acute pollution.
Notification does not curtail the duty to apply for permission pursuant to the Pollution Control Act. Notification must be given at an early stage of the planning.
The following industries have a duty to send notification:

  1. petrochemical industry,
  2. oil refineries,
  3. cellulose and paper production,
  4. production of explosives,
  5. mining and concentrator facilities
  6. herring oil factories,
  7. metallurgical industry,
  8. coking plants
  9. gas works,
  10. cement factories,
  11. incineration plants where the total applied power is 75 MW or more, or where the applied power when burning solid fuels, including waste, is 15 MW or more,
  12. discharge of phosphorus to freshwater recipient or threshold fjord with poor replacement, if the discharge is more than 5 tonnes of phosphorus per year before treatment,
  13. production of chemical raw materials, including the production of carbides, chlorine, nitric acid, sulfuric acid, ammonia, pigments, urea, fertiliser, pesticides, art resins and synthetic fibres,
  14. exploration for petroleum deposits in accordance with production license when exploration shall take place in new parts of Norwegian territorial waters or the Norwegian continental shelf,
  15. development for the utilisation of petroleum deposits.

  16. In the case of doubt, the Norwegian Environment Agency will decide whether there is a duty to send notification.
