Approval of organisations eligible to enter into agreements with extended effect according to regulations on collective licensing

The approval of the Norwegian Industrial Property Office is required in order to enter into agreements concerning extended collective licensing. Here, you will find information on how to apply and the requirements that must be met in order to obtain approval.

About this form

The following documentation shall be enclosed with the application:

The applicant must provide relevant documentation to show that the representation requirement is met, e.g. authorisation from copyright holders. Documentation that shows the organization is suitable for managing rights in the area, such as information about systems for rights management, will also be relevant for the application.

Requirements for further documentation will be specified in connection with the processing of the application. The requirements for documentation may vary, and  the Norwegian Industrial Property Office will specify what documentation is required in each case.

Criteria/conditions:

The application is directed to the Norwegian Industrial Property Office, post@patentstyret.no.

To be approved, the applicant (in the relevant area of approval) must be an organisation representing a significant number of originators of works used in Norway and must be capable of managing the rights in that area, cf. the Copyright Act § 63, third paragraph.

Fee:

There is no fee for processing the application.

Case processing deadlines:

The processing time may vary depending on the extent of the application. However, the processing time should not exceed 6 months after all necessary documentation has been submitted, cf. the regulation to the Copyright Act, § 33.

Right of appeal:

The decision from the Norwegian Industrial Property Office is an individual decision that can be appealed according to the Public Administration Act §§ 28 and 29. The deadline for filing an appeal is three weeks. The appeal body is the Media Appeals Board (Medieklagenemnda).
