Permission to utilise an invention of significance to the defence of the realm

Applications to the Norwegian Armed Forces for permission are sent to the Norwegian National Security Authority (NSM) for processing on behalf of the Norwegian Armed Forces.

Criteria/conditions:

If anyone wishes to utilise an invention as mentioned in Section 2 of the Act relating to inventions of significance to the defence of the realm, he/she must submit a complete written presentation of the invention to the Norwegian Armed Forces, or submit an application for a patent in the ordinary manner to the Norwegian Industrial Property Office (NIPO) if you wish the invention to be legally protected as industrial property.

Case processing deadlines:

The application is processed within the deadlines stipulated by the Public Administration Act, following the regulations for handling cases under the Act on Inventions of Significance for the Defense of the Realm.

Fee:

There is no fee for processing applications.

Right of appeal:

A decision can be appealed to the Ministry of Defence

Industrial property rights:

An application for legal protection (industrial property rights) is submitted to the Norwegian Industrial Property Office as a regular patent application with information indicating that the application concerns a defense-important invention. The application will be processed in the same manner as regular patent applications, and in accordance with any requirements for the protection of information resulting from the fact that information about the invention is classified.
